Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the websites, online services, and related digital properties operated by AvaloniaUI OÜ ("Avalonia UI", "we", "us"), including avaloniaui.net and its subdomains, the Customer Portal, documentation, and community features (collectively, the "Site").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

These Terms apply to website and online service use only. The licensing and use of Avalonia UI software products is governed by the Avalonia UI Master Terms and Conditions and the applicable Product Schedule(s), available at https://avaloniaui.net/legal-center.

2. Eligibility

You must be at least eighteen (18) years of age to use the Site. By using the Site, you represent that you meet this requirement.

3. Permitted Use

You may use the Site to access information about Avalonia UI products and services, manage your Avalonia Account and licences, access documentation and downloads, submit and track support requests, and participate in community features where available.

You agree not to: (a) use the Site in violation of any applicable law or regulation; (b) attempt to gain unauthorised access to any part of the Site or its underlying systems; (c) use automated tools, bots, or scrapers to access the Site without Avalonia UI's prior written consent; (d) interfere with or disrupt the Site or its infrastructure; (e) misrepresent your identity or affiliation; or (f) use the Site to transmit malware, spam, or other harmful content.

4. Intellectual Property

All content on the Site, including text, graphics, logos, documentation, and software, is the property of Avalonia UI or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without Avalonia UI's prior written consent, except for reasonable personal or internal business use of documentation made available for that purpose.

The Avalonia UI name, logo, and product names are trademarks of Avalonia UI. Use of these trademarks is governed by Avalonia UI's Trademark Policy, available at https://avaloniaui.net/legal-center/trademark-policy.

5. User Content

If you submit content to the Site (such as community forum posts, feedback, or support requests), you grant Avalonia UI a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display that content for the purposes of operating and improving the Site and our services. You represent that you have the right to submit any content you provide and that it does not infringe the rights of any third party.

Avalonia UI may remove any user content that violates these Terms or that we reasonably consider inappropriate, without prior notice.

6. Privacy

Your use of the Site is subject to Avalonia UI's Privacy Policy, available at https://avaloniaui.net/legal-center/privacy-policy. By using the Site, you acknowledge that you have read and understood the Privacy Policy.

7. Third-Party Links and Services

The Site may contain links to third-party websites or services not owned or controlled by Avalonia UI. We are not responsible for the content, privacy practices, or availability of any third-party sites. Your use of third-party sites is at your own risk and subject to their terms and policies.

8. Disclaimer of Warranties

The Site is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by applicable law, Avalonia UI disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Avalonia UI does not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Avalonia UI's total liability for all claims arising from your use of the Site shall not exceed one hundred Euros (€100).

In no event shall Avalonia UI be liable for any indirect, incidental, consequential, special, or exemplary damages, including loss of profits, data, business opportunities, or goodwill, even if advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be lawfully excluded or limited.

10. Termination

Avalonia UI may suspend or terminate your access to the Site at any time if you breach these Terms or if required by law. Upon termination, your right to use the Site ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) shall continue in effect.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Estonia, without regard to conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply. Any dispute arising from these Terms shall be submitted to the exclusive jurisdiction of the courts of Tallinn, Estonia.

If you are a consumer resident in the European Union, nothing in these Terms affects your rights under the mandatory consumer protection laws of your country of residence.

12. Changes to These Terms

Avalonia UI may update these Terms from time to time. If we make material changes, we will provide reasonable notice by posting a prominent update on the Site. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms. If you do not agree, you should stop using the Site.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
