This Privacy Policy applies to the information and data collected by AvaloniaUI OÜ and its affiliates ("Avalonia UI", "we" or "us") when you interact with our websites, products and services ("Services"), including our websites at avaloniaui.net and subdomains, the customer portal, support services, SDKs, developer tools, and marketing communications. Avalonia UI is committed to protecting the privacy of its users, those visiting our web pages ("Site"), and people interacting with Avalonia UI. Any personal data processed by Avalonia UI through its web pages or related to the downloading or use of our products or services is processed only pursuant to applicable data protection legislation.
This Privacy Policy applies where Avalonia UI is the "data controller" and is generally responsible for and controls the processing of your personal data collected through our Site, our services, and about our general business contacts.
This Privacy Policy does not apply to the privacy practices of third parties we do not control, nor does it cover end users of applications built by our customers (customers are responsible for their own end-user privacy notices).
There can be various legal bases for the processing of personal information. Below you can find legal bases under which Avalonia UI processes personal data covered by this policy and the duration of such processing.
Legitimate Interests. Where applicable, Avalonia UI may process personal data based on our legitimate interests. Where Avalonia UI processes personal data based on a contract with you, we typically will retain the information for the duration of the contract plus the additional limited period of time necessary to comply with law or a statute of limitations for legal claims under the contractual relationship.
Legal Obligation. Where we are processing personal data based on a legal obligation, we will retain the information for the period of time necessary to fulfil the legal obligation.
In all cases, Avalonia UI also considers the amount, nature and sensitivity of the personal data, as well as the potential risk of harm from unauthorised use or disclosure of such personal data.
Providing the Services: Avalonia UI uses data collected to operate and provide our services and sites. We process user personal data in reliance on our legitimate interests in operating, improving, and providing you with the services and sites you access or request. This can include providing services via our web shop, standard sales processes, or evaluation licence processes. We collect payment and billing information when you register for certain paid services. Payment information, such as payment card details, is collected via secure payment processing services of a third-party service provider.
Account and Administrative Communications: Avalonia UI may use personal data to send you information related to our services such as confirmations, invoices, expiration and renewal notices, technical notices, service updates, security alerts, and support messages to perform our contract with you, or in reliance on our legitimate interests in administering our services.
Providing Customer Support: Personal data in account information may be used to provide support services, including to help provide, improve, and secure the quality of our services and sites, or to investigate security incidents in reliance on our legitimate interests.
Handling Contact Requests: If you fill out a web form, request support, or contact Avalonia UI by other means, we may use your information to respond to your contact mechanism, perform our contract with you, or, if we do not have a contract with you, in reliance on our legitimate interests in responding to your request(s) and communicating with you.
Improving and Developing the Sites and Services: Like most websites, Avalonia UI collects information when users interact with the sites. We use cookie data and usage data to improve the sites in reliance on our legitimate interests in developing and improving the sites, or with your consent. Further, we may collect anonymous, aggregated usage data at build time to understand how our framework is used and to guide development priorities ("telemetry data"). This data is anonymised through hashing and does not include personal information, source code, or file paths. Because this data is anonymous, it falls outside the scope of personal data regulation; however, developers may opt out via the mechanisms described in the product documentation.
Marketing Communications: In certain instances, Avalonia UI uses personal data collected to reach out to you about services we think might be of interest to you. This information is provided where you have given your prior consent, when you ask to be contacted by us, or, where permitted by applicable law, in reliance on our legitimate interest in marketing our services. You may opt out of receiving marketing communications at any time by clicking the "Unsubscribe" link at the bottom of any marketing email or by contacting us. If you have other contact with Avalonia UI (e.g., as an account holder, user, or event attendee), we may still communicate with you regarding security updates, product functionality, responses to service requests, or other transactional, non-marketing purposes.
Securing the Services: Avalonia UI may process personal data and cookie data for the purposes of maintaining the safety and security of our sites and services, including verifying accounts, investigating suspicious activity, and enforcing our terms and policies, in reliance on our legitimate interest in promoting the safety and security of our sites and services, systems and applications, and in protecting our rights and the rights of others. Because our products may be distributed via third-party package managers and other means not controlled by us, we primarily record data when activation and usage of our products occurs, as well as when downloads take place through our own systems. Where we suspect licence abuse or activity that is harmful or unlawful, we may cross-reference data from different sources, including product activation records, usage data, and previously collected telemetry data, to identify and investigate the activity in question. We may also use third-party IP-to-company resolution services to associate IP addresses with organisations as part of this process. We may among other things provide to a company records of product activations, usage, and downloads associated with an IP address linked to the company or in relation to which the name of the company has been provided by a user. This can also include names and email addresses of users that register as users of that specified company. This information allows your company or institution to make decisions about things like licence compliance, purchasing more licences, additional seats, or features.
Complying with Legal Obligations: Avalonia UI may process personal data when cooperating with public and government authorities, courts or regulators in accordance with our legal obligations under applicable laws, to the extent this is required and necessary.
Avalonia UI may process personal data that:
a user actively provides during account creation or otherwise in response to forms or questionnaires, interactions with support functions, or sales inquiries and transactions, such as the name and physical address, email addresses, telephone numbers, job title, and employer of a user;
is available from third parties related to or relevant for the use or licensing of our products and services, or is related to the use of the website, products or services, such as download history and IP address as well as information on the users' activities while using the website, products or services.
In addition to the data submitted to us via our web pages, Avalonia UI may collect data about visits to our pages and the use of our websites, products or services to improve, develop and test our websites, products and services, as well as for data and product security and related purposes. To the extent reasonably possible, data regarding visits to the website and use of the website and services is anonymised or pseudonymised.
Avalonia UI retains personal data for as long as we reasonably require it for legal or business purposes, taking into consideration local laws and contractual obligations. These considerations include the nature of the personal information collected and the purposes for which it was collected.
Avalonia UI does not sell personal data to third parties. We may engage service providers to process personal data, including to provide website-related services. Avalonia UI may, for its legitimate business purposes as set out in this Privacy Policy, and subject to the limitations of applicable law, transfer such personal data to third parties to the extent such transfers are reasonably necessary for our business purposes. If you make any purchases via our web shop or any other online marketplace, we use third-party service providers to enable the store as well as third-party service providers to process payment information. A current list of our sub-processors, including details of the data they process and the applicable legal bases, is available in our Sub-Processors list. You may also request this information by contacting us using the details listed at the end of this document.
Given the global nature of Avalonia UI's business, processing data for the above purposes may involve a cross-border transfer of data provided to us from the European Union or European Economic Area ("EU/EEA") to a location outside the EU/EEA. Any cross-border transfer of the data, including any transfers outside the EU/EEA, will be carried out in compliance with applicable laws. Where EU/EEA personal data is transferred outside of the EU/EEA to a jurisdiction not subject to an adequacy decision of the European Commission, the primary transfer mechanism used shall be the European Commission's Standard Contractual Clauses. You may obtain a copy of the relevant Standard Contractual Clauses (where applicable) by contacting us using the details set out at the end of this policy.
In addition to transactional communications, Avalonia UI processes your personal data to send you marketing information, product recommendations and other non-transactional communications (e.g., marketing newsletters) about Avalonia UI and our selected partners in accordance with your marketing preferences and our legitimate interest in conducting marketing. You may opt out of receiving such communications at any time. You can opt out by clicking the "Unsubscribe" or "Manage Preferences" links at the bottom of any marketing email you receive from us. If you have other contact with Avalonia UI (e.g., as an account holder, user, or event attendee), we may still communicate with you regarding security updates, product functionality, responses to service requests, or other transactional, non-marketing purposes.
For the purposes of keeping your data secure, Avalonia UI takes appropriate technical and organisational measures designed to protect against its unauthorised or unlawful processing and against its accidental loss, destruction or damage. We strive to protect your personal data, but we cannot guarantee the security of your data which is transmitted to our website, applications or services or to other websites, applications and services via an internet or similar connection. If we have given you (or you have chosen) a password to access certain areas of our websites, applications or services, keep this password safe and secure.
We may disclose your personal data to any prospective seller or buyer of Avalonia UI business or assets. Additionally, if Avalonia UI is involved in a merger, acquisition, or sale of all or a portion of its assets, personal data may be among the transferred assets. If Avalonia UI or its assets are acquired, the acquiring company would possess your personal data and that company would assume the rights and obligations regarding your personal data as described herein. If this occurs, we will notify you via email and/or a prominent notice on our website of change in ownership, use of personal data and choices you may have regarding personal data.
Our services and sites are not directed at individuals under eighteen (18). We do not knowingly collect personal information from children under 18. Do not use our services if you are younger than 18. If we become aware that anyone under 18 has provided us with personal information, we will take steps to delete that information.
According to the applicable data protection laws and regulations (e.g., EU General Data Protection Regulation (2016/679)), you have rights regarding your personal data, including the right of access, rectification, erasure, restriction, objection, data portability, and the right to withdraw consent where applicable. Under the GDPR and certain other laws, you are entitled to lodge a complaint with the supervisory authority concerning the processing activities carried out by us. For Avalonia UI, the lead supervisory authority is the Estonian Data Protection Inspectorate (Andmekaitse Inspektsioon), Tatari 39, Tallinn 10134, Estonia (www.aki.ee). You may also contact the supervisory authority in your country of residence.
Avalonia UI does not engage in automated decision-making, including profiling, that produces legal or similarly significant effects concerning you.
Residents of other jurisdictions (including California, USA and other US states with applicable privacy laws) may have additional rights under their local laws, including rights of access, deletion, correction, and opt-out of certain data sharing. We do not sell personal information. Avalonia UI will not discriminate against any individual for exercising their privacy rights.
